A federal appeals court is currently reviewing Illinois’ assault weapons ban after a judge ruled it unconstitutional. One key issue is how Illinois defines an “assault weapon.” Some experts argue that the differences between weapons considered assault weapons and those that are not can seem trivial.
For example, the Taurus TX22, a semi-automatic gun, is banned in Illinois as an assault weapon. However, the Smith & Wesson 500, one of the most powerful revolvers in the world, is not considered an assault weapon and is legal in the state.
Firearms expert Sergio Serritella, who owns a gun store and shooting range in Lockport, explained that design features like a pistol grip or a thumb hole in the stock of a weapon can determine whether it’s classified as an assault weapon. He pointed out that these features don’t affect how the weapon functions, but are seen as cosmetic differences.
Serritella showed how some shotguns, like the Benelli 12-gauge, may look the same, but those with pistol grips are illegal in Illinois, while those without are legal.
U.S. District Judge Stephen McGlynn ruled that the assault weapons ban violates the Constitution, and a federal appeals court is now reviewing the case. Serritella believes the state’s definition of assault weapons is too broad and often illogical, as it includes features that don’t affect a weapon’s performance.
Serritella also showed an example of a rifle with a barrel shroud that protects the shooter from a hot barrel. This feature actually makes the weapon safer, but under Illinois law, it is enough to classify it as an assault weapon.
Former Chicago Police First Deputy Superintendent Anthony Riccio shared his concern that police officers today are often outgunned. He said that, years ago, officers carried revolvers with a limited number of shots. Now, criminals have access to weapons that can fire 30, 40, or even 50 rounds.
Riccio believes the solution is stronger enforcement of the assault weapons ban, including putting people in jail when they break the law. He stressed that this is important for both law enforcement and public safety.
